Article 1 – Definitions

  • Company: GoSIM, operating under the name Simkaartamerika.nl, located at Tol 2, 4267 ES Drongelen, registered at the Chamber of Commerce under number 97135313.
  • Customer: the natural person or legal entity entering into an agreement with the company.
  • Product: eSIM profiles for use in the United States of America, delivered by Simkaartamerika.nl.
  • Agreement: the distance agreement concluded between the company and customer via the website Simkaartamerika.nl.

Article 2 – Applicability

These terms and conditions apply to every offer of the company and to every distance agreement concluded between the company and customer.

Article 3 – Offer and information

The offer contains a complete and accurate description of the offered products.

The eSIMs are local products providing unlimited internet.

Article 4 – Formation of the agreement

The agreement is formed when the customer places an order via the website and the company confirms it by email.

Payment must be made in advance via one of the offered payment methods: iDEAL, Bancontact, PayPal, Apple Pay or credit card.

Article 5 – Delivery

eSIMs are delivered digitally. The customer receives activation instructions by email within 5 minutes.

Delivery times are indicative. Exceeding a delivery time does not entitle the customer to compensation.

Article 6 – Right of withdrawal and returns

For eSIMs, the right of withdrawal applies until the activation date. After activation of the product, returns are no longer possible.

Article 7 – Use of the product

The eSIM is intended exclusively for personal use during a stay in the United States.

Unlawful or fraudulent use, including commercial resale or abuse, is prohibited and may lead to immediate termination of the service without right to refund.

Article 8 – Liability

The company is not liable for damage resulting from the use or inability to use the eSIM, except in case of intent or gross negligence.

Article 9 – Force majeure

The company is not obliged to fulfill any obligation if prevented by circumstances beyond its control.

Article 10 – Privacy

The company processes personal data in accordance with applicable legislation and solely for the execution of the agreement. See the privacy statement on the website for more information.

Article 11 – Applicable law and disputes

Dutch law applies to all agreements and disputes.

Disputes will be submitted to the competent court in the Netherlands.
